§1. General provisions

  1. These Terms of Service (the "Terms") set out the rules for using the OnlyMoment service available at onlymoment.net.
  2. The Service is made available by the owner of the Service (the "Service Provider") as a technical tool enabling the creation of messages and the generation of links for viewing such messages within a limited time period or a limited number of views.
  3. By using the Service, the User accepts these Terms. If the User does not accept the Terms, the User must stop using the Service.

§2. Definitions

  1. User – any person using the Service.
  2. Message – any content entered by the User in the Service.
  3. Link – a unique reference enabling access to a Message.
  4. Password – an optional password set by the User as an additional safeguard for access to a Message.
  5. View / Viewing – the successful display of a Message to the recipient after providing access data (the Link and, where applicable, the Password).
  6. Validity period – the time after which the Link expires, or the moment after the first Viewing in the one-time mode.

§3. Anonymous use

  1. The Service is designed to be used without registration and without creating an account.
  2. The Service does not require the User to provide identifying data (such as name, surname, address or telephone number) in order to use the core functions of the Service.
  3. The User undertakes not to include in Messages any third-party personal data or any content whose disclosure could violate the law or third-party rights, unless the User has the relevant authority and a lawful basis to do so.
  4. The User acknowledges that the ICT infrastructure (e.g., servers/hosting) may automatically process technical data necessary to establish a connection and protect the operation of the Service (e.g., request logs). This does not constitute identification of the User by the Service Provider nor the creation of user profiles.

§4. Service functionalities

  1. The Service enables the User to:
    1. create a Message,
    2. select a viewing mode: one-time or multiple-time (until the expiry time),
    3. set an expiry time for the Link,
    4. set a Password (optional),
    5. generate a Link to the Message.
  2. The Service may be provided free of charge. The Service Provider may enable voluntary support of the Service (e.g., donations or similar features).

§5. End-to-end encryption and lack of access to content

  1. The Service uses end-to-end encryption.
  2. Information for Users (recommended to also display in the Service interface):

    IMPORTANT: The Service uses end-to-end encryption. Message content is encrypted on the User's device. The Service Provider has no technical ability to freely read Message content without the access data (Link/Password), which remains on the User's side.

  3. The User acknowledges that the confidentiality and security of Messages depend in particular on:
    1. protecting the Link and Password from unauthorised access,
    2. the security of the User's and recipient's device and browser,
    3. the method of transmitting the Link (e.g., compromised e-mail inbox, messenger, recipient's device).

§6. Particularly important warnings and limitations of intended use

  1. The Service is solely a technical tool for temporary content sharing and is not:
    1. a service for permanent or archival data storage,
    2. a service guaranteeing that the content will not be captured or retained by the recipient,
    3. a service intended for storing "critical" data (including sensitive data, legally protected secrets, account credentials, cryptographic keys, seed phrases, 2FA codes, passwords, banking data, or evidence-type content).
  2. The User must assume that the recipient may capture or retain the content (e.g., screenshot, photograph, copying, screen recording) and that the Service cannot prevent this.
  3. The User bears full responsibility for:
    1. selecting the recipient,
    2. the method and channel of transmitting the Link/Password,
    3. the scope of the shared content,
    4. the consequences of disclosure or retention of the content by the recipient or any third party.
  4. By sending a Link/Password, the User confirms that the recipient is authorised to access the content and that the User has the right to share such content.

§7. Rules of use and prohibited activities

  1. The User uses the Service at their own risk and undertakes to use the Service in compliance with applicable law.
  2. It is prohibited to use the Service for:
    1. unlawful activities (including fraud, extortion, impersonation, harassment or threats),
    2. infringement of copyrights, personal rights, or legally protected secrets,
    3. distributing malicious content, phishing or malware,
    4. attempts to bypass security measures, disrupt the Service, or conduct load testing without consent.
  3. The User bears sole responsibility for the Message content and the manner and purpose of its sharing.

§8. Link expiry and persistence of content

  1. In one-time mode, the Link expires after the first Viewing.
  2. In multiple-time mode, the Link remains active until the selected expiry time and then expires.
  3. The User acknowledges that Link expiry and the "one-time viewing" mechanism do not constitute a guarantee of irreversible deletion of content on the recipient's devices or within the recipient's applications.

§9. Service Provider's liability – exclusions and limitations

  1. The Service Provider makes the Service available "as is" and exercises due care to ensure that it operates correctly; however, the Service Provider does not guarantee uninterrupted operation, error-free performance, or full availability at all times.
  2. Due to the nature of the Service and end-to-end encryption, the Service Provider generally does not control or verify Message content, and responsibility for the content and its consequences rests with the User.
  3. To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any claims, damages or losses arising out of or in connection with:
    1. Message content and the manner in which it is used, shared or interpreted,
    2. disclosure, interception, misdelivery, compromise or loss of the Link/Password,
    3. acts or omissions of recipients of Links and any third parties,
    4. capturing, dissemination or further forwarding of the content by a recipient,
    5. interruptions, errors, technical limitations, failures, force majeure, or actions of third parties (e.g., hosting/network providers).
  4. If, notwithstanding the above, liability of the Service Provider arises, it shall—unless mandatory provisions of law provide otherwise—be limited to direct, actual damages and shall exclude lost profits.
  5. Nothing in these Terms is intended to exclude or limit liability to the extent such exclusion or limitation is prohibited by mandatory law.

§10. Protective measures and availability

  1. The Service Provider may introduce technical limits (e.g., message size, request rate, retention time) and apply anti-abuse protections.
  2. The Service Provider may temporarily restrict or block access to the Service (e.g., for specific addresses, ranges, or requests) where justified by security, operational stability, or suspected abuse.
  3. The Service Provider may suspend the provision of the Service for maintenance or upgrades.

§11. Rights to the Service

  1. All rights to the Service (including code, layout, and marks) belong to the Service Provider or duly authorised third parties.
  2. The User is granted the right to use the Service only to the extent necessary to use it in accordance with these Terms.

§12. Abuse reports

  1. The Service may provide a channel for abuse reports. The absence of a contact channel does not constitute an obligation of the Service Provider to provide individual support.
  2. The User acknowledges that, due to end-to-end encryption, verification of certain reports may be limited.

§13. Amendments to the Terms

  1. The Service Provider may amend these Terms for valid reasons (changes in functionality, security, or legal requirements).
  2. The current version of the Terms is published in the Service. Continued use of the Service after amendments constitutes acceptance of the amended Terms.

§14. Final provisions

  1. Matters not governed by these Terms shall be governed by applicable law.
  2. If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
  3. Disputes shall be resolved by the court having jurisdiction over the Service Provider, unless mandatory provisions of law provide otherwise.
